The Founders who wrote it didn't believe themselves to be "creating rights", for they believed in natural law, with man's rights being given by God. Without natural law and the Divine origin of rights, the 9th Amendment makes no sense at all.
"The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.". How does one know what 'other' rights people have?

But isn't the ninth amendment simply a blank check for anyone to declare something as a "right"?
